HAUSPAY LLC ("us", "we", or "our") operates the website, www.hauspay.com (the "Site"), under the business trade name “HAUSPAY”. This page informs you of our policies regarding the collection, use and disclosure of Personal and Business Information we receive from users of the Site (this “Privacy Policy”).

INFORMATION COLLECTION AND USE

While completing this form or using our Site, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you. Personally identifiable information may include, but is not limited to your name ("Personal Information"). Examples of Personal Information may include: name, email address, account numbers, login ID, Driver’s License information, IP address and phone number.

By using the Site (or any of our services) and completing the form, you agree to the collection and use of Personal Information in accordance with this Privacy Policy.

We may also further collect information about the browser, IP address, device (including device ID and advertising ID), and operating system you're using. We might look at what site you came from, what you view within our Site, and/or what other website you visit when you leave us. We may collect your location using GPS, a cellular network location, Wi-Fi networks, browser services, or information you provide.

Further by using the Site we may also collect other information you submit through our online services, such as requests to enroll in offers and alerts, and what you write when you chat with a customer service agent. We collect information when you complete an online survey. We will collect information when you click a link.

We may use your Personal Information to:

  • Process and establish your merchant processing account for the acceptance of credit / debit / gift card payments.

  • Process your payment transactions.

  • Protect against and prevent fraud, and other legal or information security risks.

  • Provide you with personalized services and recommendations.

  • Operate, evaluate and improve our business, which may include data anonymization and analytics.

  • Serve other purposes for which we provide specific notice at the time of collection, and as otherwise authorized or required by law.


SHARING YOUR INFORMATION

We will share your information in the following circumstances:
We may use your Personal Information to contact you or provide services as per our agreement.

We will share information with our member sponsor Bank(s) and its family of companies. This includes Wells Fargo Bank, N.A. and Central Bank of St. Louis as well as current and future respective subsidiaries or affiliates thereof

We will share this information with our service providers. For example, we share information such as your phone number or e-mail address with service providers who send texts or e-mails on our behalf. We may also share information with companies that operate or analyze our online services. We may share information with companies who perform advertising services on our behalf.

We will share this information with our business partners. For example, we may share information with our business partners to fulfill an advertising campaign. For example if you click on a social media widget within our online services; if you "like" us from our Website, we will share that information to the social media site.

We will share this information if we have to in order to comply with the law or to protect ourselves. We may share information to respond to a court order or subpoena. We may share it if a government agency or investigatory body requests. We may share information when we are investigating potential fraud.

We may share this information with any successor to all or part of our business. If part of our business is sold we may give our customer list as part of that transaction. 

We may share this information with third parties at your request or with your authorization.

While we strive to use commercially acceptable means to protect your Personal Information, we cannot guarantee its absolute security.  We cannot guarantee that the Internet is not 100% secure. We cannot promise that your use of our online services will be completely safe. We encourage you to use caution when using the Internet, for example, do not use our online services on jailbroken or rooted devices and do not share your passwords.

We store information in the United States (U.S.). If you live outside of the United States, you understand and agree that we may transfer your information to the U.S. Our Online Services and associated practices are subject to applicable U.S. laws.

TERMINATION OF THE TERMS OF SERVICE

You may terminate your [merchant] agreement and these Terms of Service by closing your account at any time. When you close your account, any pending transactions will be cancelled. Any funds that the bank is holding in custody for you when you close your account, less any applicable fees, costs and amounts, will be paid out to you, assuming all payout-related authentication requirements have been fulfilled (for example, you may not close your account as a means of evading any fees or amounts due to the Bank or HausPay, conduct or facilitate a fraud). We or the bank may hold your funds for any of the reasons described in this agreement or merchant agreement.  If you terminate your agreement prior to the expiration of the term thereof, you may be assessed termination fees, costs and other amounts (per property or account).   

We may terminate your account at any time at our sole discretion. In addition, the bank or any other authority having jurisdiction over the Site and services, may terminate your account at any time and for any reason, including, without limitation, if any act or omission by you results in harm or the loss of goodwill to such bank.  Other reasons for which your account may be terminated by the bank, or any other authority having jurisdiction over the Site and services may include, but are not limited to: (a) a material deterioration in your financial status or condition; (b) invalid, prohibited, or otherwise unacceptable sales deposits; (c) excessive chargebacks; and/or (d) any violation of this agreement or merchant agreement, the Rules, or any applicable law. 

You may request from us reasonable assistance relating to tokenization extraction/data migration or transitioning a merchant to another payment processor/facilitator; such assistance will be billed to you at our then-current rates. We cannot guarantee the success of any extraction of merchant data, as such tokens will depend on client’s configuration of the services. You agree to indemnify, defend and hold harmless HausPay for any claims arising from our compliance with your request to provide a copy of the token/stored data card transactions.

We will not be liable to you for compensation, reimbursement, or damages in connection with any termination or suspension of the Site or services. Any termination of the merchant agreement or this agreement does not relieve you of any obligations to pay any fees or costs accrued prior to the termination and any other amounts owed by you to us as provided in this agreement or merchant agreement.

CHANGES TO THIS PRIVACY POLICY

This Privacy Policy is effective as of May 1, 2019 and will remain in effect except with respect to any changes in its provisions in the future, which will be in effect immediately after being posted on this page. We reserve the right to update or change our Privacy Policy at any time and you should check this Privacy Policy periodically. Your continued use of the Site or any of our services after we post any modifications to the Privacy Policy on this page will constitute your acknowledgment of the modifications and your consent to abide and be bound by the modified Privacy Policy.  If we make any material changes to this Privacy Policy, we will notify you either through the email address you have provided us, or by placing a prominent notice on the Site.
